Antitrust Litigation and Counsel
The firm handles antitrust matters for both plaintiffs and defendants. We have successfully prosecuted and defended civil claims under Sections 1 and 2 of the the Sherman Act, the Clayton Act, and the California Cartwright Act, and we have successfully represented defendants and "targets" of criminal investigations in cases that have concerned alleged price-fixing, horizontal market allocation, and other alleged criminal violations of the Sherman Act.
William A. Markham litigates antitrust cases in San Diego and elsewhere in California, having acquired substantial experience as an antitrust litigator of major antitrust cases at a prominent international law firm (Coudert Brothers). He has developed an active interest in the application of antitrust law to internet service markets, internet infrastructure markets, telecommunications markets, computer software markets, and the use/misuse of intellectual property by biotechnology firms and others. He also closely follows emerging trends in antitrust law as well as competition policy in Europe and Mexico, and he has analyzed the conflict between US antitrust law and the First Amendment right to petition the government for redress.
